Please read our MAIN PAGE and Our detailed Heartland Homes Experience to fully understand what we've had to go through with our newly built home.
We hired our own structural engineer to review the issues we have.
Keeping in mind our issues started 3 MONTHS after closing on our brand new Heartland Homes built home.
Please review some of the high level details as you scroll down to see our costs to date with owning our brand new Heartland Homes home.

A brand new home leaks for a reason or reasons, Heartland Homes Pittsburgh our builder told us they will "continue to work towards a solution.." as stated
on our MAIN PAGE or Our Detailed Heartland Homes Experience web pages. Full emails from Heartland Homes are posted.
NO solution, NO resolution, NEVER heard from builder after our 1 year warranty was over until we filed our BBB case, then trial.
Heartland Homes did NOT have an engineer come to our home to point certain things out to us.

We did not initiate any actions until Heartland Homes walked away from our water issues and never asked if our issues were resolved.
When we sent the certified letter to the Heartland Homes office, the letter was signed for and we never received a response from Heartland Homes owners.
We had no other course but to take action.
We are not difficult people to work with at all. We work hard, saved our monies and spent a few years looking for the right home we wanted to buy.

Here is what we spent in legal fees to try to get our water issues resolved. Please keep in mind, during our
1st year, we were told specifically by Heartland Homes "WET BASEMENT remedy to begin...", "DUE TO THE
EXTREME AMOUNT OF WATER..." & "WE WILL CONTINUE TO WORK TOWARDS a SOLUTION..." SEE ABOVE...

2007 Legal Fees we paid = $5,188.25
2008 Legal Fees we paid = $10,998.78
2009 Legal Fees we paid = $3,229.35

all totaled we paid $19,416.38 just in legal fees and our water issues were never resolved.
Total out of our pocket to date paid including deposition fees, BBB arbitration materials, etc = $26,026.83

MOST OF OUR COMPLETE DETAILS ARE POSTED ON OUR MAIN PAGE OR
OUR DETAILED HEARTLAND HOMES EXPERIENCE PAGE.

Engineer reports we paid to have done.
This report was very high-level, as I thought that is all we needed for court.
That wasn't the case as we found out after our trial started.

This is the report that should have been initially submitted to court.

in image form instead of PDF as above.
The Structural Engineer we paid to put together the reports
and was our expert witness at our trial performed both inspections.

NOTE: At NO time did Heartland Homes ever have a
Structural Engineer come to our home to inspect our issues and
make recommendations on what it would take to resolve our
water infiltration issues.
Without a doubt I can state that is a fact.

We are not builders or in home construction. IN OUR OPINION: FLASHING and WEEP HOLES are installed for a reason.
Even the window manufacturer Andersen Windows state "UNIT must be properly flashed...".
Building Code 2003 state flashing and weep holes are to be installed, etc.  Please read our MAIN PAGE link above for details.

Here is 1 of our contractors proposals to repair the issues with our home that was built brand new in 2003 into 2004.
We closed February 2004 on our brand new home, 3 months later May 2004, we started experiencing water infiltration issues into our home.

Hopefully you read the emails on our main page from Heartland Homes stating our "WET BASEMENT remedy to begin..." &
"Due to the EXTREME AMOUNT OF WATER..." &

"We will CONTINUE TO WORK TOWARDS a solution...",
we never see that solution, here is what 1 of the bids we received figured it would take to resolve our issues.

Please keep in mind the following key NOTES:
1. For our trial in December 2008, we got 4 bids. We showed each contractor all of our photos,
showed them around our home and explained that our water issues
started only 3 months after our brand new 1st owner home closing.

2. As I mentioned before, for our trial I specifically told our Structural Engineer our report simply needed to prove we have
water issues with our home, so he did just that.
We were told AFTER we submitted all 4 estimates, we only needed to pick 1 estimate to work from.
They were not going to call all 4 contractors to testify on the
witness stand. So we picked this same contractor we would have picked anyhow.
Once our trial starts we find out, over 3/4 of his proposal is thrown out
because our expert witness, the Structural Engineers report does NOT detail out all of his items in the proposal, so whatever is NOT in the
Structural Engineers report will NOT be permitted as a repair in the proposal or however they worded this.

3. We file our discontinuance for our trial, because we've spent over $26,000.00 already and we haven't done any
repairs to our home other than replacing our electrical panel. We chisel out brick, pulled back vinyl siding and ask our Structural Engineer
and this 1 contractor to come back out and look at what is behind our brick and vinyl siding.
See the photos above, as you will see there is no flashing installed, etc..

4. Even though we still have a lot of photos and details to post, however you can easily see, we have
problems with our home that started 3 months after we closed. I don't see how that can be mistaken or contradicted?

In our opinion we did get 4 bids from 4 different contracting companies.
We picked 1 bid because we were told to for our trial. Because 3/4 of his proposal was tossed out we figured there is no reason to go any further with the trial, so we filed a discontinuance.

This proposal below is what we feel is actually what it will take to fix our water infiltration issues.
According to our Structural Engineer, 2000 & 2003 Building Codes and Andersen Windows, our window manufacturer;
FLASHING is to be installed. We removed 5 bricks and pulled back siding and found no flashing.

According to our Structural Engineer and the 2000 & 2003 Building Codes, weep holes are to be installed;
we have no weep holes in our bottom rows of brick or anywhere below our windows to allow water to drain.

IMPORTANT DETAILS: IN our opinion, if our home was built in 2003 and we have the building permit posted signed in 2003.
International Building Code from 2003 stating "...flashing shall be installed at the perimeters of exterior doors and windows..."
How come in the 5 areas WE REMOVED brick & siding, there is no flashing? See photos below, links above, etc. We have tons of photos showing we have
NO FLASHING installed in the areas where we removed brick or siding. According to our expert structural engineer, flashing and weep holes are to be installed
which falls inline with the Andersen Windows document & the IBC 2003 documentation.
IMPORTANT: Heartland Homes never had any structural engineer visit our home. We would have known and part of our court transcripts state that.

We always want to make sure we provide all of the details we have, so you have a complete picture.
We are still beside ourselves every single day realizing everything we had to go through and continue. You can click on our Court Trial Details tab above.
You'll see we won the verdict from the Judge.
However we decided to discontinue our case because we will be over $50,000.00 upside down in our case with the monies settlement.
We are just going to pay for all of our repairs ourselves because we have spent some much of everything already trying to get the builder to resolve our issues.

February 2004 - close on our brand new Heartland Homes home.
May 2004 - started having water infiltration issues, notified builder throughout entire time (click here to see all 50+ emails with digital photos).
February 2005 - warranty over, no issues resolved. See photos on Main Page or go to www.daverome.com for more granular details.
May 2005 - sent certified letter to owner of Heartland Homes, Alan Gillespie or Marty Gillespie - no response after 3 weeks. (click underlined link to read)
June 2005 - Filed case with the Pittsburgh Better Business Bureau. (click underlined link to read)
2005 - 2007 - Various work performed on our home by Heartland Homes, no resolution still and new problems introduced (water in electrical panel/garage).
2007 - Hired an attorney to represent us legally. We thought our issues would have been resolved during our 1 year warranty with our brand new home, not the case.

Since we never heard back from the builder Heartland Homes, we decided our next step would be the Better Business Bureau. After we file our BBB case; Heartland Homes contacted us and they did perform some repairs.
Those repairs did not resolve any of our issues. , additionally Heartland Homes stated the work they performed was a "courtesy"..
Click link to go to our detailed website www.daverome.com, scroll 1/2 down the first column and look for the section titled: ...Pittsburgh Better Business Bureau Case Overview... to read all of the details..

So we hired an attorney to pursue this legally. In our opinion we continued to make phone call after phone calls for updates about our issues during our BBB case. Once we found rain water in our electrical panel, this was the icing that made us decide on hiring an attorney and moving things forward. (click link to see all of the photos and details with water infiltrating our electrical panel, BEFORE we had to replace our electrical panel at our own expense.) Also READ the email from Heartland Homes Warranty Department stating they found a "compromised conduit" that was allowing water to enter our electrical panel, etc.. The pictures show the electrical conduit disconnected from where the electrical service enters our home.

ACTUAL FEES WE HAVE PAID TO DATE...
None of the monies listed below include any hours we've spent on pursing our new home issues. Our time is simply our time, period.
Consider the thousand ++ hours taking pictures, detailed timelines for BBB case and court, etc.. IMAGINE!

LEGAL FEES we paid to pursue resolving our issues with our Heartland Homes home. Attorney Invoices only (we are not posting invoices but we have receipts and invoices for every expense we've incurred outside of what we should have had to pay after buying a brand new built home)...
2007 calendar year legal expenses associated with our Heartland Homes lawsuit we paid
(we initially filed our case).
$5,188.25
2008 calendar year legal expenses associated with our Heartland Homes lawsuit we paid. $10,998.78
2009 calendar year legal expenses associated with our Heartland Homes lawsuit we paid til March 2009. $3,229.35

TOTAL LEGAL FEES WE'VE INCURRED TO DATE March 2009 $19,416.38
Better Business Bureau case & arbitration prep; photos, photos mounted, binders, etc for hearing.  $458.90
DEPOSITION FEES we paid to pursue resolving our issues with our Heartland Homes home. $895.75
STRUCTURAL INSPECTION & EXPERT WITNESS TESTIMONY FEES we paid to pursue resolving our issues with our Heartland Homes home.

$4270.80
ELECTRICAL PANEL REPLACEMENT due to extensive water infiltration into our electrical panel, our Structural Engineer told us we should replace the panel and breakers due to the way things looked.
Could have arched and caused fire in our home.
$985.00

TOTAL MONIES SPENT pursuing OUR NEW HOME ISSUES                       $26,026.83+

Additionally the $26,026.83 we have spent to date does not include any repairs we have yet to do.
I will post that information as well, our bids came back $22,000 - $29,000 approximately.

Since we now know FLASHING was not installed per the manufacturers instructions + no weep holes were installed, there is
some major repair work required. See our detailed Structural Engineers report above.

Please keep in mind: at NO time did Heartland Homes ever have a Structural Engineer or
Structural Inspector come inside our home to look at our issues, at no time. This fact can not be disputed!
