We pursued legal action in
2007, trial in 2008, verdict in our favor in 2009.
The monies portion of our verdict barely covered any repairs and none of our legal fees nor our additional fees would be reimbursed.
Since our Structural Engineering report was not detailed enough, most of our contractor proposal was thrown out.

We never had to deal with any courts or attorneys, or anything like this before, so how do you really know what is needed?
We've spent thousands of hours on this entire new home experience. We've taken at least a thousand + pictures and we've literally spent over $26,000.00 just to try to get our water issues resolved with our brand new 1st owner home.
Since our water issues were never resolved and now we know we have no flashing installed in areas behind our brick, around our door and around our dining window, our repairs will be over $20,000.00 as well.

Then we decided to file a discontinue our trial in 2009 due to the fact we would be over $50,000.00 upside down. Our 4 proposals for repairs are over $20,000.00+ just for repairs.

Our out of pocket money just to pursue action against Heartland Homes cost us over
$26,000.00 in BBB arbitration materials, Structural Engineering fees, attorney fees, deposition fees,
replacing our electrical panel in a home that is a few years old built brand new. $19,416.38 just in legal fees.

Water starts infiltrating our brand new home 3 months after we close... Builder notified immediately and every time thereafter.

First the Heartland Homes warranty Department state on 3 different occasions.

NOTE: the photos to the right - during the entire 1+ year timeframe, you see no differences in water infiltration. The water issues still remained, even though the emails we received indicated something was being done. We didn't see it and our photos don't show it!
 

April 2005 - we no longer receive any responses back from Heartland Homes Warranty Department.
May 2005 - we started seeing more water, etc. - I call the Warranty Department again because I don't hear back from the Warranty Department the last few times I left messages in April 2005, now it is May 2005.
NOTE: We never hear back from Heartland Homes again regarding (until we file our Better Business Bureau case) our water issues or resolving our water infiltration issues. We've had water infiltration issues since 3 months after closing on our home, it is now 1 year later and they never follow up with us to see if our issues still exist, etc.. 
May 2005 - We send the certified letter to the owner(s) of Heartland Homes Alan Gillespie, Marty Gillespie and receive no response after 2+ weeks, see below.

June 2005 - we file a complaint against Heartland Homes Pittsburgh. This finally engages Heartland Homes office to contact us.
June 2005 - Vice President of Heartland Homes Marty Gillespie comes to our home to look at our issues and specifically state what steps need to be taken to resolve our issues.

Below is Heartland Homes response to the complaint we filed with the BBB (better business bureau)

June 29 2005 - received signed letter from Heartland Homes stating they met with me, Dave Romesburg
and discussed solutions for our "WET BASEMENT", etc...  Shortly around this time is when Marty Gillespie (Vice President of Heartland Homes) came to our home to check out our issues and introduced me to Craig, the foreman that would be responsible to take care of our issues.

Please note the "WET BASEMENT" terminology used.

We believe this has significant because Heartland Homes warranty does NOT cover "damp spots"

July 2005 - August 2006 - Heartland Homes performs trenching work on front and side of our home, however this does not resolve our issues. Instead two new issues surface: water issues in our electrical panel and now we start to see rain water infiltrating our garage foundation cinder block walls.

Below is Heartland Homes response to the BBB when we found water in our electrical panel multiple times

July 2006 - August 2006 - we find rain water in our electrical panel on 5 different occasions. Heartland Homes states they find a compromised conduit outside. All of this happened after water testing was done by Heartland Homes. Eventually we end up spending almost $1,000.00 to replace the electrical panel ourselves. Heartland Homes warranty states they are not responsible for consequential damages (whatever the term is they used)

With the water infiltration into our electrical panel because of however the electrical conduit outside being "compromised". We started pushing our issues further, our dryer stops working. We replace our one unit laundry system, only to find out our new dryer does not work. Here part of the 220 breaker is now bad. We are not electricians, HOWEVER if water infiltrated our electrical panel 5 times, and we never had issues with our washer or dryer before, what would you think?

November 3 2006 (State Attorney Generals Office) - Heartland Homes (attorney) responds to the PA State Attorney Generals Office for the same complaint we filed with the Pittsburgh Better Business Bureau (BBB).

This document seems to be a little different than what we were experiencing? (Heartland Homes never asked us if our situation still existed. We are not sure how they monitored our situation as they indicated in their response to the State Attorney Generals Office?)

In our opinion if they did monitor our situation they would have asked to come into our home or they would have asked us one way or another if our issues were resolved, right? 2 years after this letter was sent to the State Attorney Generals Office; we were asked at our trial IF our issues still existed. It was our attorney that asked us that question and yes our issues still exist.)

NOTE: "Heartland Homes offered to paint basement wall but Mr Romesburg declined said offer due to his

We believe most or almost all of our water infiltration issues are coming from ABOVE our foundation.
That area was never touched, except for Heartland Homes spraying a brick sealant on the lower portion of our home, that was it.
 

2007 - we start legal process and that is another process that took a lot of time and a lot of monies!

2008/2009 - Court trial non-Jury December 2008: Judge Olson finds in our favor. Without going in to a lot of detail right now, the verdict is in our favor, however the monies portion we won covers minimal. We did not submit detailed enough information in our engineers report initially (that was our fault because we had no idea how much detail was needed) and once you submit your evidence that is what they base everything on. We did not find this out until our trial started and most of the repair items were thrown out.

When you match up our photos, showing no flashing installed in areas and no weep holes installed and all of this water infiltrating our home, you can imagine there is definitely some work that will need to be completed.
If the company that builds your home can't resolve your issues, then there must be something going on, right? 

January 8 2009 - Judge Olson's verdict in the favor of Plaintiffs: David Romesburg and Christopher Rojik and against Defendant: Heartland Homes.  Click to read verdict from Judge.

We won the verdict.  The monies portion of the verdict was appealed by Heartland Homes. Then we had a damages only short trial just for the siding, nothing else. Since the initial monies awarded barely covered anything and that was appealed, we decided to just discontinue anything else. We already lost thousands and thousands of dollars, along with thousands of hours we will never get back.
However we still won the verdict that we did have issues with our home! Finally after 5 years, finally!

January 2009 (after Judge Olson's verdict) - Heartland Homes does not appeal the verdict itself, only the monies portion of the verdict.  Click to read appeal filed.

All totaled for repairs + all fees we paid, including engineer, legal fees, etc = over $53,000.00 we will be out of our pocket.

Does it make sense for us to even continue a damages only trial, we will be upside down over $53,000.00 or more? Definitely not..

1st year, we were told specifically by Heartland Homes "WET BASEMENT remedy to begin...", "DUE TO THE
EXTREME AMOUNT OF WATER..." & "WE WILL CONTINUE TO WORK TOWARDS a SOLUTION..." SEE ABOVE...

2007 Legal Fees we paid = $5,188.25
2008 Legal Fees we paid = $10,998378
2009 Legal Fees we paid = $3,229.35
all totaled we paid $19,416.38 just in legal fees and our water issues were never resolved.
Total out of our pocket to date paid including deposition fees, BBB arbitration materials, etc = $26,026.83

2009 to date - I did a little research and actually removed 5 bricks from our brick veneer front and siding and found out no window flashing was installed around the areas where brick was removed. See our main page, last column for all of those details and photos as well... Andersen Windows clearly states "standard window flashing" is to be installed.. See that 2002/2003 document on our Main Page as well. We received that document from Heartland Homes when we closed on our home.
Photos are posted, documentation is posted and I will also post the IRC building codes from 2003 and possibly 2000.
Our home was built in 2003, I also have our building permit as well...

The trenching never resolved our water infiltration issues and after the issues with our electrical panel now, we
pursue legal action. Without going into a lot of detail right now; we won our case, however we should have submitted
more substantial details in our Engineers report than we did, so the verdict was in our favor, however the monies barely covered
any repairs, much less the over $21,000.00 we spent to that time with legal fees, inspections, replacing our electrical panel, etc.

NOTE: No one from Heartland Homes ever asked to enter our basement or home during the times we reported the water infiltration into our basement. Never at any time did Heartland Homes have a Structural Engineer come to our home to point out our issues or explain to us exactly what it will take to correct our issues, never once!

A lot has transpired during our first Heartland Homes new home experience of over 5+ years.
Never at ANY time were we ever asked to open our home to a structural engineer or structural inspector representing
Heartland Homes.
 
#1. February 20 2004, we close on our brand new Heartland Homes townhouse.
 
STARTING May 2004, 3 months after closing on our brand new Heartland Homes custom home; we start experiencing water infiltration into our basement foundation, Heartland Homes builder notified immediately and throughout.

 #4a. June 2005 - Marty Gillespie of Heartland Homes Pittsburgh (Vice President of Heartland Homes Pittsburgh at that time. President of Heartland Homes Pittsburgh now in 2009), contacts me (Dave Romesburg) states he did not realize we have issues with our home. Sets up an appointment to come to our home, along with Craig Faulkner from Heartland Homes.

During their visit,  Marty Gillespie reviews our issues, appoints Craig Faulkner as my point of contact and states (paraphrasing) we will get your issues taken care of or resolved, period.
 
#5. June 29 2005 - Received a signed letter from Rick Murray of Heartland Homes Warranty Manager: "We met with Mr. Romesburg and discussed solutions for his door and wet basement..." click to read signed letter from Heartland Homes.  Click link to see all correspondence, including June 29 2005 letter.
 
#6. Fall 2005 - Our entire front door, door frame and threshold is replaced by Heartland Homes as part of our case with the Pittsburgh Better Business Bureau.
 
#7. Jan 2006 - March 2006 - Our entire front and side of our home is trenched. French drain replaced, Tuff & Dri waterproofing reinstalled, trench filled with 120 ton of quarry stone.

NOTE: None of this work resolves our water infiltration issues to date still.

#8. July 2006 - Heartland Homes performs water testing in the front of our Heartland Homes townhouse to see where water is still infiltrating our foundation from. Water testing performed.
 
#9. July 2006 - we find rain water on the floor of our basement, directly under our Electrical Panel installed in the same area where water has been infiltrating our home now for 2+ years almost every time it rains. We have well over 1,000 photos during our 5 years with the water infiltration issues.   Click here to see the initial email with photos sent to Heartland Homes, along with an immediate phone call to Heartland Homes.       Eventually we pay almost $1,000.00 to replace our electrical panel and all of the breakers in the panel.

NOTE: We open our electrical panel to find water throughout the electrical panel. We notify Heartland Homes immediately, they contact an electrician and various work is performed to attempt to correct this situation. See photos of our electrical panel infiltration issues by clicking here.

#11. August 2006 - Water infiltration issues are still not resolved. We continue with the same water infiltration issues since May 2004.
 
#12 - October 2006 - Filed a complaint with the Pennsylvania State Attorney Generals office regarding our issues. State Attorney Generals office will keep our complaint on file, however they handle complaints basically the same as the BBB, Arbitration.

We wanted to get our issues resolved and the BBB at least got Heartland Homes engaged, because they did walk away from our issues after our 1 year warranty was over and none of our water infiltration issues were resolved. Nor did Heartland Homes ever contact us to ask if our issues were resolved at any time. However we did not want another arbitration, we wanted to resolve our issues because now it is over 2 years later since our issues had started. We are the 1st owners of this Heartland Homes experience.

#13. October 4 2006 - Letter from Heartland Homes to the Pittsburgh Better Business Bureau because we requested a BBB arbitration hearing; "Company states they are currently working with customer to remedy the problems.. Company seeks to make repairs..."
 
#14. October 17 2006 - Letter from Heartland Homes to the Pittsburgh Better Business Bureau: "Company states work they performed was a courtesy.. Company seeks to be released from any further responsibility, etc..." click here to read.
 
#15. December 2006 - Started looking at legal options. We were told the Statute of Limitations for New Construction issues was 4 years.

We are over 2 years December 2006 with water infiltration issues. We believe the trenching work was the reason for the "compromised conduit" into our electrical panel.
 
#16. January/February 2007 - Hire an Attorney and start the legal process...
 
Note: Had to submit details, photos, our depositions alone with Heartland Homes attorney was at least 5+ hrs. By the time documents are filed, paperwork, and everything involved that brought us up to December 2008 when we actually have our trial.                              We had our Structural Engineer come to our home, contractors for estimates, etc...

  NO structural engineer, other than the engineer we paid, asked to come into our home at any time to see our issues.
  5 solid years of documentation and photos provide all of the details anyone could want to see what our new home experience is....

NOTE: Soon we will post our Structural Engineers report(s), the proposals from our contractors, the exhibits from Heartland Homes testimony, etc: This will show that because we did not set up the start of our trial with the detailed information we should have, the monies portion of our verdict barely covered any repairs. Additionally we spent well over $22,000.00 in legal fees and nothing would be reimbursed.  

All totaled for repairs + all fees we paid, including engineer, legal fees, etc = over $50,000.00+ we will be out of our pocket.

Does it make sense for us to even continue a damages only trial, we will be upside down over $50,000.00+ or more? Definitely not..

#20. April 27 2009 - Our request to Judge Olson to please discontinue our trial and damages settlement. Click here to see the discontinuance. We still won the verdict in our favor, however the monies portion is barely something that would cover any type of repairs to our home. It would cost us more in legal fees.

We've been battling this for almost 5 years now. We are exhausted and honestly in our opinion; We could not have provided any more details or information than we already have. Literally thousands of photos, tons of emails, phone calls, etc?? What are we missing? Think about buying a brand new home where you are the very 1st owner, what an exciting time in your life, right?

We have always made Heartland Homes very well aware of our issues since day 1.

MAJOR NOTE: They did come to our home to trench the front and side of our home, AFTER we have to file a case with the Pittsburgh Better Business Bureau.

Our water infiltration issues are still not resolved and we spent $197,000.00 for our Heartland Homes townhouse + $30,000.00 in legal fees, engineer reports and testimony + cost over $22,000.00 to repair (minimally, I will post the contractors proposals). A major factor will be that flashing was not installed around our Andersen Windows, per the manufacturers recommendations. Those photos will be posted shortly, where I removed brick from our brick veneer as well as vinyl siding to prove flashing was not installed in those areas. In our opinion IF flashing was not installed in those areas, we believe flashing wasn't installed in the other areas as well.   

GRAND TOTAL $197,000.00 + $53,000.00 = $250,000.00 for a $197,000.00 custom home we bought...
This does NOT include minimally the 1,000+ hours and over 2,000+ digital photos we had to take to prove our issues..
 

May / June 2009 - I received the transcripts from our trial. Again the verdict was in our favor and I will post the entire transcript including the portions from our builder Heartland Homes stating (for now paraphrasing) "we have issues they did not correct." This was specifically stated by 3 individuals from Heartland Homes. I will be posting this testimony soon, over the next few weeks. This is the 1st time we specifically heard someone from Heartland Homes state we have issues that were not corrected. There are other specific details I will post as well....
 


We believe most or almost all of our water infiltration issues are coming from Above our foundation. That area was never touched, except for Heartland Homes spraying a brick sealant on the lower portion of our home, that was it.

This is by no means a full detail timeline. However please note that we were told by Heartland Homes on 3 occasions before our 1 year warranty was over that they were "working on our issues", "Castleview is still a work in progress", and "we will continue to work towards a solution..." all via email, click on each link above to read that email.

After April 2005 we hear nothing further from Heartland Homes until we file our case. In the meantime though, does our water issues look resolved after our 1 year warranty?
